Why Foshwa Concept to Manage Foreign Workers in Malaysia

We are concern with the human rights issues of the migrant workers in the country. We believe all Malaysian especially the employers must take positive actions to improve the image of our country. We must protect the interest of all the parties and take pro-active steps that will encourage the foreign workers to extend their service beyond three years and reduce the rate of abscondment upon arrival.

We must stop the vicious cycle of foreign workers coming in legally became illegal workers and the employers request to bring in more workers to overcome the shortage. This will ultimately results in more illegal immigrants in our country.

Rules and Regulations

The government of the years has inroduced various rules and regulations on the employment of foreign workers (FW):

  • FW must be paid the same benefits as a Malaysian worker by the same employer.
  • Employer and FW must sign Employment Conract.
  • Before recruitment, the terms and conditions of service is attested by the respective embassies in Kuala Lumpur.
  • FW not allowed to be a union member.
  • FW not alowed to switch employer without the approval of the Immigration Department.
  • FW not allowed to marry a Malaysian.
  • Employer must inform KDN and KSM the arrival and recruitment of FW.
  • When FW absconded, the employer must make a police report and forward a copy to the Immigration Department.
  • Employer must provide orientation training to FW.
  • Employer must provide free accomodation, water and electricity.
  • Employer must insure FW under FWCS and the new medical insurance.

The Problems

  • Without FW the economy stagnated.
  • FW are responsible for the spread of communicable diseases and crimes
  • Social and economic stuggles between FW and Malaysians.
  • Abused of Human Rights
  • Corruptions.
  • Negatives image of Malaysia by foreign media.
Our economy relies heavily on the existance of FW in the country. We employ almost 2.5 million FW and many are illegal.

Why Legal FW became Illegal?

The FW who came to our country paid a life fortune for the opportunity to work with Malaysian employers. The FW hope to work for three years, recover their expenses and have some saving. Their expectations are clearly stipulated in the Employment Contract and also the Attestation Document at their Embassies:

  •  The employer honour the Employment Contract.
  • Provide them the securiy of tenure.
  • Provide a safe work place.
  • Provide a healthy work environment and accomodation.
  • Provide them with basic welfare as agreed in the Employment Contract.
  • Pay them accordingly as per Employment Act 1955
  • Treat them in accordance with the laws and do not abused their Human Rights.
We are advocating FOSHWA concept  - Foreign Workers, Safety, Health and Welfare Agency. We believe this paradigm shift will make the FW serve longer in the country and we can reduce the illegal FW. The real benefit is the high productvity of experienced FW against newly recruited FW.
